1. Agreement

By creating an account or using The Night Library, you agree to these Terms. If you don't agree, don't use the service.

These Terms are between you and Eidetic LLC. "The Night Library" is the product's name; Eidetic LLC is the company behind it.

Our Privacy Policy explains what we do with your information and is part of this agreement.

2. Who may use it

You must be 18 or older and able to enter a contract.

You must be the parent or legal guardian of every child whose photograph or likeness you upload, and you must have the right to give us that photograph. Do not upload photographs of anyone who has not consented — and for a child, that consent is yours to give only if the child is yours.

Children do not get accounts. An adult holds the account; the children in the stories are subjects, not users.

3. Your account

Keep your sign-in credentials to yourself. You're responsible for what happens under your account.

Access is currently by invitation. We open registration in stages. An invitation is not a promise of permanent access, and we may close registration at any time.

A household may include additional members you invite. You remain responsible for what your household members do here.

4. What you may and may not do

Do: make books about your family, your kids, your pets. Share them with people you love. Print out a page and stick it on the fridge.

Don't:

• Upload photographs of anyone you aren't the parent or guardian of, or who hasn't consented
• Try to create sexual, violent, hateful, or otherwise harmful content, or content that sexualizes a minor in any way
• Impersonate a real person other than the members of your own household
• Upload anything you don't have the rights to
• Resell, sublicense, or commercially redistribute books made here (see §7)
• Reverse-engineer, scrape, or attack the service, or try to extract our prompts or models
• Use the service to build a competing product
• Circumvent your plan's limits

We may remove content and suspend or terminate accounts that break these rules. For anything involving the sexualization or endangerment of a child, we will terminate immediately and report as the law requires.

5. Plans and payment

5.1 The free tier

A new account may create and finish one book, once — a lifetime allowance, not a monthly one. It exists so you can see what the product actually does before paying for it. When it's used, you'll need a subscription to create another book.

Your existing books remain readable and shareable whether or not you subscribe.

5.2 Subscriptions

All prices in US dollars, exclusive of any applicable tax.

A subscription is per household, not per person. Members of your household are included.

Founding Family pricing is limited to the first 100 households and is offered by invitation. It is not available for self-service selection, and a founding subscription cannot be switched to another plan from the billing portal — write to us and we'll handle it. As long as you keep the subscription active, the founding price holds.

5.3 Billing

Payments are processed by Stripe. We never see or store your card number.

Subscriptions renew automatically at the end of each period — monthly or annual, matching what you chose — at the then-current price for your plan, until you cancel. Charges appear on your statement as NIGHTLIBRARY.

If a payment fails, we'll retry and email you. If it keeps failing, your subscription may be cancelled and your household returns to free-tier limits.

5.4 Cancelling

You can cancel any time from the billing portal in your account.

Cancellation takes effect at the end of the period you've already paid for. You keep full access until then. We do not prorate or refund partial periods.

After cancellation your books stay readable and shareable; you just can't create new ones beyond free-tier limits.

5.5 Refunds

We aren't required to give refunds beyond what the law requires. That said: if something goes materially wrong on our end — a book that never generates, a charge you didn't intend — write to support@eidetic.bot. We'd rather fix it than argue about it.

5.6 Price changes

We may change prices. For existing subscribers we'll give at least 30 days' notice by email, and the new price applies from your next renewal. If you don't like it, cancel before then. Founding Family pricing is exempt for as long as that subscription stays active.

5.7 Generation limits

Every plan has limits on how much can be generated per day — stories, illustrations, redraws, narration. AI generation costs us real money per image, so unlimited generation is not something we can honestly offer. Current limits are shown in your account.

6. AI-generated content — what to expect

The stories, illustrations, and narration here are produced by AI models. That means:

• Output varies. The same inputs can produce different results.
• A character may not look exactly like your child. We work hard at likeness, and we check it automatically, and it still sometimes misses.
• A story may be odd, flat, or occasionally wrong. Read it before bedtime, not during.
• Generation can fail. When a batch fails you can retry the failed parts; a failed generation costs you nothing against your quota.
• Similar outputs may be generated for other users. We don't promise your illustration is globally unique.

We don't warrant that any particular output will be suitable, accurate, or what you pictured. You are the adult in the room: review what you make before sharing it with your child.

7. Who owns what

7.1 Your inputs

You keep everything you upload and write — photographs, names, personality notes, premises. It's yours. You grant us a limited licence to host it, process it, and send it to our AI providers for the sole purpose of making your books work. That licence ends when you delete the content or your account. We do not use it to train AI models. We do not use it for advertising, and we will not use it for marketing without asking you first.

7.2 Your books

You own the books you make — the story text, the illustrations, the character sheets, the narration audio — to the fullest extent ownership in AI-generated material is possible. We assign you whatever rights we have in them.

A caveat worth understanding: the copyright status of AI-generated material is unsettled in the United States and elsewhere. Purely machine-generated output may not be protectable by copyright at all. We can give you everything we have; we can't give you more certainty than the law currently provides.

You may print your books, share them, put them on your wall, and give them as gifts. You may not sell them or redistribute them commercially — this is a family product at a family price, not a content-production licence.

You grant us a narrow licence to store your books, render them, and serve them to anyone holding a share link you created. If you'd like us to feature a book publicly, we'll ask first, every time.

7.3 Ours

The software, the design, the prompts, the models and pipelines, and the names "The Night Library" and "Eidetic" are ours. Using the service doesn't give you rights to any of it.

7.4 If you publish a character

If you publish a character to the in-app marketplace, you grant other users of the service the right to import and use that character's illustrated sheet in their own books. Your photographs are never published or copied. Imported copies stay with the family that imported them — including after you delete your account. Consider that before publishing a character based on a real child.

8. Sharing links

Share links are public capabilities. Anyone with the link can read the book. Revoking a link stops new visits but doesn't reach copies already saved — this is explained in §5 of the Privacy Policy, and you should read it before sharing a book about your child.

9. Service availability

We're a small operation. We'll do our best to keep it running, but we don't promise uninterrupted service. We may modify, suspend, or discontinue features. If we discontinue the service entirely, we'll give reasonable notice and a way to export your books.

10. Termination

You may stop any time by deleting your account from your account page. Deletion is immediate and irreversible; §4.3 of the Privacy Policy explains exactly what goes and what stays.

We may suspend or terminate an account that breaks these Terms, creates legal risk, or abuses the service. Where circumstances allow, we'll tell you why and give you a chance to export your books first. For violations involving children's safety, we act immediately.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.

Some jurisdictions don't allow these exclusions, so some may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIDETIC LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS.

Nothing here limits liability that cannot be limited by law.

13. Indemnity

You'll defend and indemnify Eidetic LLC against claims arising from your content, your use of the service, or your breach of these Terms — including any claim that you lacked the right to upload a photograph you uploaded.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Disputes go to the state or federal courts located in Texas, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. For material changes we'll give at least 30 days' notice by email before they take effect. Continuing to use the service after that means you accept them. If you don't, cancel and delete your account.

16. Odds and ends

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the service.
• Severability. If a provision is unenforceable, the rest survives.
• No waiver. Not enforcing something once doesn't waive it.
• Assignment. You can't assign these Terms. We may, in connection with a merger or sale of the business.
